RISE TRAINING CENTER - RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT
PLEASE READ CAREFULLY. BY SIGNING THIS DOCUMENT, YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
This Agreement is entered into by and between the participant, hereinafter referred to as "Participant", and Rise Training Center, hereinafter referred to as "RTC".
1. ACKNOWLEDGEMENT OF RISKS: Participant acknowledges that Krav Maga, Kickboxing, and Fitness activities involve inherent risks and dangers, which may result in illness, personal injury, death, property damage, or other loss. Participant assumes all risks associated with participation in RTC activities.
2. RELEASE OF LIABILITY: Participant hereby releases, waives, discharges, and covenants not to sue RTC, its officers, employees, agents or family members from any and all liability arising out of or related to any loss, damage, illness or injury, including death, that may be sustained by Participant, whether caused by the negligence of RTC or otherwise, while participating in such activity, or while in, on, or upon the premises where the activity is being conducted.
3. INDEMNIFICATION: Participant agrees to indemnify and hold harmless RTC from any loss, liability, damage, or costs, including court costs and attorney's fees that RTC may incur due to Participant's participation in said activities.
4. PHOTO AND VIDEO RELEASE: Participant grants RTC the right to photograph and/or videotape Participant and further to use said Participant's name, face, likeness, voice, and appearance in connection with exhibitions, publicity, advertising, and promotional materials without reservation or limitation. RTC is hereby released from any and all claims, demands, causes of action and suits, in law or in equity, whether the same be known or unknown, anticipated or unanticipated, which Participant has or may have, arising out of or in connection with the use of said photographs and/or videotapes.
5. SEVERABILITY: If any term or provision of this Agreement is held to be illegal, invalid or unenforceable, or the application thereof to any person or circumstance shall to any extent be illegal, invalid or unenforceable under present or future laws effective during the term hereof or of any provisions hereof which survive termination, then and in any such event, it is the express intention of the parties that the remainder of this Agreement, or the application of such term, clause or provision other than to those as to which it is held illegal, invalid or unenforceable, shall not be affected thereby, and each term, clause or provision of this Agreement and the application thereof shall be legal, valid and enforceable to the fullest extent permitted by law.
Participant acknowledges that he/she has read this Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement, understands its terms, understands that he/she has given up substantial rights by signing it, and has signed it freely and voluntarily without any inducement, assurance, or guarantee being made to him/her and intends his/her signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
